1. Services

FORGE provides website design and development, lead generation systems, and related digital services to trade and home service businesses. Specific deliverables, timelines, and pricing are agreed per client in a separate written agreement or quote.

We reserve the right to decline or discontinue services at our discretion.

2. SMS messaging programme

Description of the SMS programme

FORGE operates an SMS messaging programme to communicate with prospective and active clients about their booking, enquiry, or project. This programme is used for the following purposes:

• Booking confirmations and appointment reminders for discovery calls
• Follow-up messages after a discovery call or enquiry submission
• Responses to questions or information you have requested from us
• Notifications related to an active project or service

This programme is not used for bulk promotional marketing.

How to opt in

You may opt in to receive SMS messages by checking the clearly labelled, unchecked opt-in checkbox on our booking form at forgewebonline.com/learn-more. Consent is not required to use our services or book a call.

How to opt out — Text STOP

You may opt out of receiving SMS messages from FORGE at any time by:

• Replying STOP to any SMS message you receive from us
• Emailing jake@forgewebonline.com with a request to be removed from SMS communications

After opting out, you will receive a single confirmation message and no further SMS messages will be sent. Opting out does not affect any services you have engaged or paid for.

How to get help

For assistance with SMS messages, reply HELP to any message or contact us at jake@forgewebonline.com. We will respond within 1 business day.

Message frequency

Message frequency varies by enquiry stage. Typically 3 to 5 messages per booking or project enquiry cycle. You will not receive recurring automated marketing messages.

Message and data rates

Standard message and data rates may apply depending on your mobile network carrier and plan. FORGE does not charge for SMS messages sent through this programme.

Carrier liability disclaimer

Carriers such as AT&T, T-Mobile, Verizon, and others are not liable for delayed or undelivered messages. Message delivery is subject to carrier network availability and conditions. FORGE is not responsible for delays, failures, or errors in message delivery caused by carrier networks or factors outside our control.

No sharing of SMS opt-in data

Your mobile number and SMS opt-in consent will not be sold, transferred, shared, or disclosed to any third party for marketing purposes. This is an absolute policy with no exceptions. See our Privacy Policy for full details.

3. Age restriction

Our services and SMS programme are intended for business owners and individuals aged 18 and over. By using our website, booking a call, or opting in to SMS, you confirm that you are at least 18 years of age. We do not knowingly engage with or collect data from anyone under 18. If we become aware that a person under 18 has provided data or opted in to SMS, we will delete that information immediately.

4. Payments and pricing

Service pricing is set out in your individual quote or agreement. Payment is due as specified in that agreement. We reserve the right to pause or discontinue work where payment is overdue. All prices are in the currency stated in your quote.

Refunds are not offered on completed work. Disputes should be raised within 7 days of delivery.

5. Intellectual property

Upon receipt of full payment, you own the final website design and content produced for your project. FORGE retains the right to display completed work in our portfolio unless you request otherwise in writing.

We retain ownership of any proprietary tools, frameworks, templates, or code libraries used in building your project that were not created specifically for you.

6. Limitation of liability

FORGE's total liability to you for any claim arising from our services is limited to the total amount paid by you for the specific service giving rise to the claim in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of revenue, loss of data, or business interruption, even if we have been advised of the possibility of such damages.

We are not responsible for the performance of third-party platforms (including hosting providers, CRM platforms, or payment processors) integrated into your project.

7. Confidentiality

Both parties agree to keep confidential any non-public information shared during the course of a project. We will not disclose your business information, pricing, or project details to third parties without your consent.

8. Website use

You may use our website for lawful purposes only. You must not use it to transmit spam, malware, or any content that is unlawful, harmful, or infringing. We reserve the right to restrict access to our website at any time without notice.

9. Changes to these terms

We may update these Terms of Service periodically. The current version will always be published at forgewebonline.com/terms.html with an updated effective date. Continued use of our services after changes constitutes acceptance of the updated terms.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection law in your location requires otherwise.
